1. INTRODUCTION
These Terms of Service ("Terms") govern your use of the services provided by Voyagio & Hygge Lifestyle ("we," "us," or "our"), a brand operating under Hygge Lifestyle. By accessing our website, engaging our services, or making a booking, you ("Client" or "you") agree to be bound by these Terms, which constitute a legally binding agreement.
2. NATURE OF OUR SERVICES
We act as an intermediary, consultant, and facilitator for bespoke, tailored travel and lifestyle experiences. Our role is to plan, organize, and facilitate arrangements with third-party suppliers, including but not limited to hotels, airlines, charter companies, local guides, and transport providers. We are not the principal service provider for the underlying travel components.
3. CLIENT RESPONSIBILITIES
3.1. By engaging our services, you agree to:
- 3.1.1. Provide accurate, complete, and truthful information, including all personal details, passport, visa information, and any health or dietary requirements.
- 3.1.2. Ensure that all travel documents (passports, visas, health certificates) are valid for the entire duration of the trip and meet the requirements of the destination countries.
- 3.1.3. Mandatory Travel Insurance: It is a mandatory condition of our service that you obtain and maintain comprehensive travel, accident, and health insurance for the entire duration of your trip. This insurance must cover, at a minimum: trip cancellation, medical expenses, accidental death or injury, emergency evacuation, baggage loss, and personal liability. We reserve the right to request proof of such insurance at any time prior to your travel.
- 3.1.4. Adhere to all local laws, customs, and regulations of the countries you visit.
4. PAYMENT, BOOKING & CANCELLATION POLICY
4.1. Booking Confirmation: A booking is considered confirmed only upon our receipt of a non-refundable, interest-free deposit. The amount and due date of this deposit will be specified in your booking invoice.
4.2. Final Payment: Full and final payment for the trip is due no later than 60 days prior to the commencement of travel.
4.3. Cancellation by Client: In the event that you wish to cancel your booking, the following cancellation fees will apply based on the number of days prior to the trip's start date:
- 4.3.1. 90+ days: 10% cancellation fee of the total trip cost
- 4.3.2. 61 to 90 days: 20% cancellation fee of the total trip cost.
- 4.3.3. 46 to 60 days: First deposit is non-refundable. Any payments beyond the deposit will be refunded.
- 4.3.4. Less than 45 days: No refunds (100% cancellation fee)
4.4. Cancellation by Third Party: Any refunds for cancellations will be subject to the policies of the third-party suppliers. We will endeavor to secure a refund on your behalf but cannot guarantee a full refund.
5. LIMITATION OF LIABILITY & INDEMNITY
5.1. Voyagio's Role: We shall not be held liable for any act, omission, or default of any third-party supplier, including but not limited to airlines, hotels, tour operators, and transport providers.
5.2. Indemnity: You agree to indemnify and hold harmless Voyagio & Hygge Lifestyle, its directors, officers, and employees, from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising from your negligence, breach of these Terms, or any act or omission during your travel.
5.3. Maximum Liability: Our total liability to you, for any and all claims arising out of or in connection with these Terms or the services provided, shall not exceed the total amount paid by you to us for the specific booking in question.
5.4. Limitation on Consequential Damages: We shall in no event be liable for any indirect, consequential, special, punitive, or exemplary damages, including but not limited to loss of income, loss of revenue, loss of business opportunity, or loss of goodwill or reputation, even if we were advised of the possibility of such damages.
5.5. Insurance Disclaimer: We acknowledge that while we recommend and mandate travel insurance, it is your sole responsibility to obtain and ensure its adequacy. We shall not be held legally responsible for any loss, damage, or injury to you or any member of your party, or any other costs incurred as a direct or indirect result of your failure to secure appropriate insurance or to follow our directions.
5.6. Waiver of Subrogation: You waive any and all rights of subrogation against us for any claims or losses that are covered by your travel, accident, or health insurance policies. You agree that your insurance provider shall not have the right to seek recovery from us for any amount paid to you under such policies.
6. FORCE MAJEURE
We shall not be held liable for any failure to perform our obligations due to an event of Force Majeure. This includes, but is not limited to, acts of God, war, terrorism, civil unrest, natural disaster, pandemics, strikes, or any other event beyond our reasonable control. In such cases, payments made are non-refundable but may be converted into a travel credit for a future booking, subject to supplier policies.
8. DISPUTE RESOLUTION
8.1. Negotiation: In the event of any dispute, the parties agree to first attempt to resolve it amicably through good-faith negotiation.
8.2. Arbitration: If negotiation fails, the dispute shall be referred to and finally resolved by a single arbitrator appointed mutually by the parties. The arbitration proceedings, including the seat of arbitration, shall be conducted in New Delhi in accordance with the provisions of the Arbitration and Conciliation Act, 1996, and its subsequent amendments.
8.3. Confidentiality: The arbitration proceedings, including any decision or award, shall remain strictly confidential.
9. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of India. Any and all disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the District Court at Saket New Delhi, followed by the High Court of Judicature, and finally the Supreme Court of India.
10. INTELLECTUAL PROPERTY & MARKETING RIGHTS
10.1. All intellectual property rights related to our services, including our brand names (Voyagio, Hygge Lifestyle), logos, website content, and any proprietary materials, remain our exclusive property.
10.2. Grant of License for Promotional Use: By engaging our services and making content public on your social media platforms related to your trip, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, and display such public content (including photos, videos, stories, and testimonials) in our promotional and marketing materials. You may, at any time, request that we remove your content from our promotional materials, and we will take reasonable steps to comply with such a request.
11. GENERAL PROVISIONS
11.1. Disclaimer of Warranties: We make no warranties, express or implied, regarding the quality, suitability, or safety of any services provided by third-party suppliers (e.g., airlines, hotels, local operators). Our role is solely to facilitate arrangements on your behalf.
11.2. Entire Agreement: This document, along with your booking invoice, constitutes the entire agreement between you and Voyagio & Hygge Lifestyle and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral.
11.3. Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
12. CLIENT CONDUCT AND TERMINATION OF SERVICE
12.1. Client Conduct: You and all members of your traveling party agree to conduct yourselves in a lawful and respectful manner at all times. This includes, but is not limited to, compliance with the laws of the countries you visit, respect for local customs, and appropriate behavior towards third-party suppliers and staff.
12.2. Right to Terminate: We reserve the right, at our sole discretion, to terminate your trip and our services without any obligation for a refund or compensation if we or a third-party supplier determine that you or a member of your party has engaged in any unlawful, abusive, or disruptive conduct that may endanger yourself or others, damage property, or harm our brand's reputation.
13. AMENDMENT
We reserve the right to amend these Terms at any time without prior notice. The updated Terms will be effective upon publication on our website.
